These Terms of Service govern your access to and use of zend.sh. By accessing or using the Service you agree to be bound by these Terms.

By creating an account, accessing the API, or using any feature of the Service, you agree to these Terms and our Privacy Policy and Acceptable Use Policy. If you are using the Service on behalf of a company or other legal entity, you represent that you have authority to bind that entity.
If you do not agree to these Terms, do not use the Service.
zend.sh is a programmatic cold-outbound email infrastructure platform. It provides API, CLI, and MCP-server access to orchestrate sending, warmup, deliverability monitoring, and analytics across mailboxes that you connect and own ("Bring Your Own Key" model).
zend.sh does not operate its own sending mail servers for your outbound campaigns. All campaign emails are dispatched from mailboxes and sending services you connect to the platform (Google Workspace, Microsoft 365, Azure Communication Services, or SMTP/IMAP-compatible providers). You are responsible for those accounts and their compliance with the providers' own terms.
You must provide accurate information when creating your account and keep it up to date. You are responsible for maintaining the confidentiality of your API keys and for all activity that occurs under your account.
API keys carry the same permissions as your account. Rotate them immediately if you suspect compromise. zend.sh is not liable for losses caused by unauthorized use of your credentials.
Your use of the Service is subject to our Acceptable Use Policy, which is incorporated by reference into these Terms. Violating the AUP — including sending unsolicited email, abusing the warmup network, or circumventing unsubscribe mechanisms — is grounds for immediate suspension or termination.
Paid plans are billed through Stripe on a recurring basis (monthly or annual). Prices, included quotas, and overage rates are listed on our Pricing page. All fees are non-refundable except as required by applicable law or as otherwise stated in our refund policy.
We reserve the right to modify pricing with reasonable notice. Continued use after a price change constitutes acceptance of the new pricing.
You are solely responsible for: (a) the content of emails sent via the Service; (b) the lawfulness of your contact lists and your legal basis for contacting recipients; (c) compliance with all applicable laws including CAN-SPAM, GDPR, CASL, and any jurisdiction-specific requirements; and (d) the accounts and credentials you connect to the platform.
zend.sh provides infrastructure. We do not review the content of individual emails before sending, and we do not assume any liability for your content or your recipients' data.
zend.sh and its licensors retain all intellectual property rights in the Service, including the API, CLI, MCP server, warmup network protocols, and associated documentation. These Terms do not grant you any rights in zend.sh trademarks or brand features.
You retain all rights to content and data you provide through the Service. You grant zend.sh a limited license to process that content solely to provide the Service.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
zend.sh does not warrant that the Service will be uninterrupted, error-free, or that deliverability outcomes will meet any specific threshold. Email delivery depends on factors outside our control, including recipient server configurations and third-party sending providers.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZEND.SH AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.
OUR TOTAL CUMULATIVE LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNTS YOU PAID TO ZEND.SH IN THE TWELVE MONTHS PRECEDING THE CLAIM.
You may terminate your account at any time by contacting us or using the account settings. We may suspend or terminate your access at any time for violation of these Terms or the Acceptable Use Policy, with or without prior notice for material violations.
On termination, your right to use the Service ceases. Data retention and deletion follow our Privacy Policy.
We may modify these Terms from time to time. We will notify registered users of material changes via email or in-product notice. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
